1. Who May Use The App
1.1. The app is for employees, contractors and subcontractors of the Company, and other persons authorised by the Company (e.g. site visitors completing inductions).
1.2. Your access level is set by the Company based on your role and may be changed at any time.
1.3. Accounts are personal. You must not share your login, use another person's account, or let anyone else complete records under your name.
2. Purpose of the App
2.1. The app is a tool for creating, accessing and managing the Company's health & safety, quality, environmental and site documentation under its Integrated Management System (IMS).
2.2. The app does not replace your legal duties. Using the app does not discharge your obligations under the Health and Safety at Work Act 2015, your employment agreement, or Company policies. If the app is unavailable, your obligations remain — use the paper-based process and enter the record later.
3. Accuracy and Integrity of Records
3.1. Records you create in the app (inspections, sign-ons, incident reports, QA data, meeting minutes, etc.) are official Company records and may be relied on in audits, insurance matters, investigations and legal proceedings.
3.2. You must ensure every record you create or sign is true, accurate and complete, and entered at or near the time of the activity it records.
3.3. You must not falsify, backdate, pre-complete, or sign a record on behalf of another person, or record an inspection, check or meeting that did not occur. Doing so is serious misconduct and may also carry personal legal liability.
3.4. Digital signatures and sign-ons in the app have the same effect as handwritten signatures.
4. Your Account and Security
4.1. Keep your login credentials confidential. Notify the Company immediately if you suspect your account has been accessed by someone else.
4.2. Lock your device when unattended and do not leave submitted forms open for others to alter.
4.3. If you use a personal device, you are responsible for keeping its operating system reasonably up to date and protected (passcode/biometric lock).
5. Acceptable Use
5.1. Use the app only for legitimate work purposes connected with your role.
5.2. You must not: upload content that is offensive, defamatory or unlawful; upload material that infringes another party's intellectual property; attempt to access records, documents or functions beyond your authorised access level; interfere with the operation or security of the app; or extract Company data for any purpose other than performing your role.
5.3. Photos taken through the app must relate to the work being recorded. Do not photograph people in a way that is unreasonable or unrelated to the record, and follow client site rules about photography.
6. Confidentiality
6.1. The app contains confidential Company information, including IMS documents, client details, site information and commercial records. You must not disclose, copy or distribute this information outside the Company without authorisation.
6.2. Client-specific information (site layouts, security arrangements, project details) is also subject to any confidentiality obligations the Company owes its clients.
6.3. Your confidentiality obligations continue after your account is deactivated or your engagement with the Company ends.
7. Privacy and Personal Information
7.1. The app collects and stores personal information about you, including your name, contact details, role, training and competency records, PPE issue records, incident involvement, and records you create (with timestamps and, where enabled for site records, location data).
7.2. This information is collected and handled in accordance with the Privacy Act 2020 and is used for: managing health, safety, quality and environmental compliance; meeting the Company's legal obligations (including to WorkSafe NZ); training and competency management; and administering the app.
7.3. Your personal information may be shared where required by law (e.g. WorkSafe notifications), with the Company's auditors and certification bodies, and with clients where site access or prequalification requires it (e.g. induction and competency evidence).
7.4. You may request access to, and correction of, your personal information by contacting the Company.
7.5. Health information collected in incident records is handled with additional care and restricted to those who need it for investigation, support or legal compliance.
8. Monitoring
8.1. Activity in the app is logged (records created, viewed, edited, and sign-in history). The Company may review these logs for security, compliance, audit and investigation purposes.
9. Ownership
9.1. All data, records, documents and content in the app are the property of the Company (or its licensors). You acquire no rights in the app or its contents.
9.2. On ending your engagement with the Company, your access will be deactivated. Records you created remain with the Company.
10. Availability and Reliance
10.1. The Company aims to keep the app available but does not guarantee uninterrupted access. The app may be offline for maintenance or due to faults or network conditions.
10.2. The app may operate offline and sync later; you are responsible for confirming that offline records have synced.
10.3. Documents in the app are the current approved versions at time of viewing. If you believe a document is out of date or incorrect, report it — do not rely on documents from outside the app (screenshots, saved copies, printouts older than the date of use).
11. Breach of These Terms
11.1. Breach of these terms may result in suspension or removal of app access and, for employees and contractors, may be dealt with under the Company's disciplinary or contract management processes.
11.2. Nothing in these terms limits the Company's other rights or remedies.
12. Changes to These Terms
12.1. The Company may update these terms from time to time. You will be notified of material changes in the app and may be required to re-accept before continuing to use it.
13. General
13.1. These terms are governed by New Zealand law.
13.2. These terms operate alongside (and do not replace) your employment agreement or contract, the Employee Handbook, the IT, Security & Communication Policy, the AI Use Policy, and other Company policies. If there is any inconsistency, your employment agreement or contract prevails.
